General Booking Conditions 1. APPLICATION 1.1 These General Terms and Conditionsapply to all offers, reservations and agreementsrelating to all holiday villas and otherfacilitiesthat are rented out by Bronbella Resorts NV (Bronbella) or throughother companies bookingthem. 1.2 In these General Terms and Conditions, the term 'tenant' means: the person whoconcludesan agreement with Bronbella regarding the rental /use of the holiday villa. Under the term 'user' is understood: the tenant and the persons specifiedby the tenant who (will) use the holiday villa and/or otherfacilitiesrentedby the tenant. 1.3 These General Terms and Conditionsapplyregardless of your (prior) reference to any of yourownterms and conditions or to othergeneralterms and conditions. Bronbella disclaims allTerms and Conditions to whichyourefer or which up tillnow are usedbyyou. 1.4 Agreementsdeviatingfrom these General Terms and Conditions are onlyvalidifagreed in writing. 2. BOOKINGS 2.1 Bronbella willonlyprocess reservations for persons aged 18 or older. Reservations by persons underthatage are void. 2.2 Bronbella onlyaccepts reservations startingfrom 1 night. 2.3 If Bronbella processesyourreservation, Bronbella willsendyou a writtenconfirmation, whichh is as well serving as aninvoice, within 24 hoursafter the reservation has been made. Youshould check this for correctnessimmediatelyuponreceipt. Anyinaccuracies must be reported to Bronbella immediately. 2.4 Ifyou do not get a writtenconfirmation/invoicewithin 2 daysafter the reservation has been made, take immediately contact with the reservationdepartment; failing to do so means the reservationcannot be invoked. 2.5. An agreement is concludedbetweenyou and Bronbella whereby Bronbella rents the holiday villas, ownedbythirdparties, to you. Bronbella has the right to do sobyanirrevocable agreement with the owner and is authorized on behalf of the owner to conclude lease agreementswithtenants. 2.6. An agreement is concludedbetweenyou and Bronbella when Bronbella has also sent you the writtenconfirmation/invoice of yourreservation and you have transferred the prepayment part. 2.7. The agreement concerns rental of the holiday villa and/or otherfacilities for recreationaluse, whichbytheir nature is of short duration. 3. CHANGES IN THE AGREEMENT 3.1 Ifyouwish to make changes to the agreement after the agreement has been concluded, Bronbella is notobliged to accept these. It is at the discretion of Bronbella to determinewhether and to whatextentitacceptsthose changes. In case Bronbella acceptsyour changes, Bronbella maystill charge you a change fee. 4. SUBSTITUTION 4.1 The tenant and other users are notallowed to hand over use of the holiday villa underany name and for whateverreason to othersthan the persons mentioned in the agreement, unlessotherwiseexplicitlyagreed in writingwith Bronbella. 4.2 Ifyou and Bronbella have agreedthatyou and/or one or more users may be replaced, youstillwillremainjointly and severally liable to Bronbella for the payment of the part of the outstandingamount, in addition to the rent of the tenant and/or users whoreplaceyou, the change costs (see art. 3.1), anyadditionalcostsresultingfrom the replacement as well as the possiblecancellationcosts. 5. PRICES 5.1 Youowe Bronbella the agreedrentalprice, as stated in the writtenconfirmation/invoice of the reservation. If the costs of Bronbella (personnel, energy, taxes, etc.) have demonstrably and unexpectedlyincreasedafter the conclusion of the agreement, Bronbella has the right to increaseitsprices and to charge you the increasedprice. Ifthispriceincreasewill be implementedwithin 3 monthsafter the agreement has been concluded, thatpriceincreasewillamount to a maximum of 5% of the previouslyagreedprice and youwill have the right to dissolve (cancel) the agreement on that basis. 5.2 Price discounts and/or special offers can no longer be usedafter the confirmation of the reservation/invoice has been sent by Bronbella. 6. ADDITIONAL COSTS 6.1 In addition to the rent, you/the tenant will be owinganytaxes, such as VAT tax and otherlevies. 7. PAYMENTS 7.1 Reservations must be prepaid with at least 25% of the totalaccommodationcosts. The remainingamount must be paid in full at the latest at check-in. Paymentcan be made by cash or bank transfer to the relevant bank account of Bronbella. 7.2 In the event of your late payment of the amountsinvoiced to you, youwill be in default immediatelyafter the term for payment has expired. In that case, Bronbella will offer you in writing the opportunity to pay the amountstillowedimmediately. Ifpayment is stillnotforthcoming, Bronbella reserves the right to dissolve (cancel) the agreement as of the dayfollowing the 24-hour periodthat has expired and you are liable for alldamagesthat Bronbella suffers or will suffer as a result, includingallcoststhat Bronbella has had to make in connectionwithyourreservation and the dissolution. In any case, Bronbella has the right to
